Do consumer courts award compensation for mental harassment?
Yes. Where deficiency of service and consequential harassment are proved, Commissions routinely award compensation for mental agony and litigation costs over and above the refund or repair claimed.
Is there a court fee, and do I need a lawyer?
There is no court fee for claims up to five lakh rupees, and modest fees above that. You are legally entitled to argue your own case. That said, drafting and evidence discipline decide most outcomes, which is where representation earns its keep.
Which Commission do I file in?
It depends on the value of goods or services paid plus compensation claimed. Up to ₹50 lakh goes to the District Commission, ₹50 lakh to ₹2 crore to the State Commission, and above ₹2 crore to the National Commission. You may also file where you reside or work, not only where the seller is based.
How long does a consumer case take?
The Act contemplates 3 to 5 months, and simple matters do conclude within a year. Contested claims involving expert evidence, such as medical negligence, realistically take 2 to 3 years.
Can I file against a builder for delayed possession?
Yes. Homebuyers are consumers, and the Supreme Court has confirmed that the consumer remedy runs parallel to RERA — you may choose either. Refund with interest, or possession with delay compensation, are both routinely awarded.
What if the company ignores the Commission's order?
Non-compliance is punishable under Section 72 with imprisonment of one month to three years, a fine, or both. We file execution proceedings promptly, and in practice the threat of coercive action resolves most non-compliance quickly.
